(3) A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession (Section 13 of the German Civil Code, BGB). A business is a natural or legal person or a partnership with legal capacity that, when entering into the legal transaction, acts in the exercise of its trade, business or self-employed profession (Section 14 BGB).
(4) We do not accept any deviating terms of the customer unless we have expressly agreed to their validity in writing.
(5) Separate terms of use and privacy provisions apply to the use of the Azume app; these Terms govern the purchase of goods in our online shop.
§ 2 Conclusion of the Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to place an order.
(2) By clicking the "Pay now" button, you submit a binding offer to purchase the goods in your shopping cart.
(3) After receiving your order, we will send you an automatic confirmation of receipt by email listing your order once again. This confirmation of receipt does not yet constitute acceptance of your offer.
(4) The purchase contract is only concluded when we expressly accept your order by a separate order or shipping confirmation by email, or when we dispatch the goods to you.
(5) Before submitting your order, you can correct your entries at any time using the usual keyboard and mouse functions. In addition, all details are displayed once more in a confirmation window before the order is placed and can also be corrected there.
§ 3 Contract Language and Storage of the Contract Text
(1) The languages available for concluding the contract are German and English.
(2) We store the contract text and send you the order data and these Terms by email. You can also view and retrieve the Terms at any time on this page.
§ 4 Prices and Shipping Costs
(1) All prices are final prices in euros and include statutory VAT.
(2) Shipping costs may be added to the stated prices. The amount of any shipping costs will be clearly communicated to you during the ordering process before you place your order.
(3) For deliveries to countries outside the European Union, additional customs duties, taxes or fees may apply in individual cases. These are not payable to us but to the competent customs or tax authorities there and are borne by you.
§ 5 Payment Terms
(1) Payment is made using the payment methods displayed during the ordering process. Payments are processed via Shopify Payments or the payment service providers connected to it.
(2) The purchase price is due for payment upon conclusion of the contract, unless otherwise stated in the ordering process.
(3) If the customer defaults on payment, the statutory provisions apply.
§ 6 Delivery and Delivery Time
(1) Delivery is made to the delivery address you provide.
(2) The delivery time is stated on the respective product page or in the ordering process.
(3) If we are unable to deliver ordered goods through no fault of our own because our supplier fails to meet its contractual obligations (reservation of self-delivery), we are entitled to withdraw from the contract. In this case, we will inform you without delay and promptly refund any payments already made.
(4) Items marked as pre-orders (pre-sale) are delivered only from the estimated shipping start stated on the product page and in the ordering process. Details, in particular regarding the delivery period and a possible postponement of the shipping start, are set out in our Shipping Policy, which forms part of these Terms.
§ 7 Reservation of the Azume One
(1) By purchasing the "Azume One Reservation" for €1.00 (incl. VAT), you acquire the right to purchase one Azume One in the pre-sale at the pre-sale price of €99.00 (incl. VAT, plus any shipping costs) instead of the regular price of €149.00. One device may be purchased at this price per reservation. The reservation is non-transferable.
(2) When the pre-sale begins, you will receive a personal link by email to the address provided with your reservation, through which you can redeem the pre-sale price. You will receive this link at least 24 hours before we publicly announce the pre-sale. The link is valid for 7 days from the date the email is sent.
(3) During the pre-sale, we will not offer the Azume One at a price lower than the pre-sale price set out in paragraph 1.
(4) The pre-sale may be conducted via an external platform. In this case, we will inform you before redemption, and the terms of that platform will additionally apply to the purchase.
(5) The reservation does not oblige you to purchase the Azume One. The reservation fee is not credited against the purchase price.
(6) You may cancel the reservation at any time without giving reasons by emailing service@azume.com. The reservation fee will then be refunded in full and your entitlement to the pre-sale price lapses. Your statutory right of withdrawal remains unaffected.
(7) If the pre-sale has not begun by 31 March 2027, the reservation ends and the reservation fee is refunded automatically.
§ 8 Transfer of Risk
(1) If the customer is a consumer, the risk of accidental loss and accidental deterioration of the goods sold passes to the consumer only upon handover of the goods (Section 475(2) BGB).
(2) If the customer is a business, the risk passes upon handover of the goods to the carrier.
§ 9 Retention of Title
The goods delivered remain our property until paid for in full.
§ 10 Right of Withdrawal for Consumers
Consumers have a statutory right of withdrawal, about which we inform you below.
Withdrawal Policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods. In the case of multiple goods ordered in one order and delivered separately, the period runs from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the last good.
To exercise your right of withdrawal, you must inform us
WatchMePay GmbH, Wallfahrerweg 1, 82166 Gräfelfing, Germany, Email: service@azume.com, Phone: +49 176 34466328
of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory. You can also declare your withdrawal using the withdrawal function in the footer of our website azume.com.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

§ 11 Warranty / Liability for Defects
(1) The statutory warranty rights apply. For consumers, the limitation period for claims for defects in newly manufactured goods is two years from delivery of the goods.
(2) For used goods, the limitation period for consumers is one year from delivery, insofar as legally permissible.
(3) Any guarantees granted by us or by the manufacturer do not affect the statutory warranty rights and apply in addition to them. Details can be found in the respective guarantee terms, which may be enclosed with the goods.
§ 12 Liability
(1) We are liable without limitation for damages resulting from injury to life, body or health based on an intentional or negligent breach of duty, and for other damages based on an intentional or grossly negligent breach of duty.
(2) In the event of a slightly negligent breach of an essential contractual obligation (cardinal obligation), i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the customer may regularly rely, our liability is limited to the foreseeable damage typical for the contract.
(3) Otherwise, liability for slightly negligent breaches of duty is excluded.
(4) Liability under the German Product Liability Act and under any guarantees assumed remains unaffected.
§ 13 Consumer Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 14 Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a consumer, mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected, insofar as they are more favourable to the consumer.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is our registered office.
(3) Should individual provisions of these Terms be or become invalid, this shall not affect the validity of the remaining provisions.
